Warranty and Terms of Trade

By accepting the quotation provided by Shimicoat, the Client acknowledges and agrees to be bound by the terms and conditions outlined in the Shimicoat Warranty and Terms of Trade set forth below.

Warranty coverage

The Shimicoat Warranty shall provide coverage under the following conditions:

  1. 1.1 Materials for defect repair: The warranty covers the provision of necessary materials required to repair defects arising in the product, as determined by Shimicoat.
  2. 1.2 Reimbursement of material costs: The warranty covers reimbursement for the material costs already paid by the Client for repairs required under the terms of this warranty.

Warranty exclusions

The following situations are expressly excluded from coverage under this warranty. Shimicoat shall not be liable for any claims arising from the circumstances outlined below:

  1. 2.1 Vandalism or intentional damage: Damage resulting from deliberate or malicious actions, including but not limited to vandalism or intentional tampering.
  2. 2.2 Exacerbation of pre-existing damage: Damage caused by the aggravation, extension, or worsening of pre-existing damage that was not previously reported or addressed in accordance with the warranty terms.
  3. 2.3 Moisture ingress: Damage resulting from the ingress of liquids or moisture, including but not limited to prolonged pooling or accumulation of liquid on the surface, which compromises the integrity of the seal coating.
  4. 2.4 Excessive substrate moisture: Damage arising from moisture content exceeding 4% in the substrate, resulting in surface degradation, mould growth, or other forms of damage.
  5. 2.5 Exposure to sunlight and UV radiation: Damage caused by exposure to direct sunlight or ultraviolet (UV) radiation, resulting in fading, discolouration, or surface degradation.
  6. 2.6 Chemical exposure: Damage due to exposure to harsh chemicals, solvents, acids, or substances that may impair the integrity of the surface or cause degradation.
  7. 2.7 Damage from negligence: Damage arising from negligence or failure to exercise proper care, including, but not limited to, the dropping, dragging, or pushing of heavy objects across the surface or other inappropriate actions that result in harm to the installed coating.
  8. 2.8 Lack of maintenance: Damage resulting from the failure to maintain, clean, or care for the surface in accordance with Shimicoat's recommended maintenance guidelines.
  9. 2.9 Heat, fire, and extreme weather: Damage resulting from excessive heat, fire, extreme weather events (including storms, flooding, hail), or prolonged exposure to high temperatures due to UV radiation or heat generated by ovens or other high-temperature sources.
  10. 2.10 Physical movement of substrate or subfloor: Damage caused by improper or excessive movement in the substrate or subfloor, resulting in breakdown, softening, or failure of the coating.
  11. 2.11 Contaminants and foreign matter: Damage resulting from subsurface contaminants such as moisture, oils, or the permeation of foreign materials (for example calcium chloride) from beneath or within the substrate.
  12. 2.12 Surface defects in water environments: Damage occurring under water environments, such as swimming pools, ponds, or submerged areas, including but not limited to calcination, discolouration, chalking, or peeling. This exclusion also applies to damage arising from the harsh chemical composition or environmental factors in such aquatic environments.
  13. 2.13 Environmental causes: Shimicoat does not provide coverage for damage resulting from environmental factors such as UV radiation, exposure to chemicals, extreme weather conditions, or underwater conditions (for example swimming pools, ponds, and areas exposed to direct sunlight) that may lead to surface degradation or failure.
  14. 2.14 Swimming pools and ponds: Shimicoat's surface coating materials, when applied inside swimming pools or ponds, are excluded from warranty coverage due to the varying water compositions (such as pH, alkalinity, salt content, and chlorine levels), extreme exposure to UV radiation, and physical abrasion in the presence of chemicals. Clients are responsible for ensuring the suitability of Shimicoat's products for the conditions in their swimming pools and ponds.
  15. 2.15 Failure to properly cure: Damage arising from failure to allow the surface to cure properly or premature access to the surface during the curing process, which compromises the integrity of the coating.
  16. 2.16 Chemical spills: Damage resulting from spills of hazardous chemicals, including but not limited to acids, alkalis, solvents, oils, or other corrosive substances.
  17. 2.17 General wear and tear: Normal wear and tear, including scratching, cracking, gouging, marring, staining, or discolouration caused by UV exposure, shall not be covered under this warranty.
  18. 2.18 Indirect financial losses: Shimicoat shall not be liable for any indirect financial losses, including but not limited to loss of profits, consequential damages, or any other indirect losses arising from product failure or system issues.
  19. 2.19 System failure due to unforeseeable events: System failure or defects caused by factors beyond Shimicoat's reasonable control, such as natural disasters, vandalism, or other unforeseen external events, are excluded from warranty coverage.
  20. 2.20 Failure to report defects timely: Failure by the Client to report any defect, failure, or issue within seven (7) days of occurrence will void any warranty claims.
  21. 2.21 Improper isolation of affected area: Failure to adequately isolate the affected area from use or contamination during the repair process will result in exclusion of any subsequent damage from warranty coverage.
  22. 2.22 Unpaid invoices: No warranty claim will be processed unless all outstanding invoices have been paid in full. Warranty claims associated with unpaid invoices shall be deemed null and void.
3.

Client obligations for warranty claims

To facilitate the effective and timely processing of warranty claims, the Client is required to:

  1. 3.1 Timely reporting: The Client must report any defect or failure to Shimicoat immediately, providing full details of the issue, and no later than seven (7) days from the occurrence of the defect.
  2. 3.2 Clear the area for repair: The Client shall ensure that the affected area is free from obstructions, furnishings, or traffic to allow Shimicoat contractors to complete the necessary repairs. Failure to comply may result in additional charges.
  3. 3.3 Normal working hours: Warranty repairs will only be conducted during normal working hours, and any work outside of these hours may incur additional charges.
  4. 3.4 Exclusive use of Shimicoat contractors: All warranty repairs must be carried out exclusively by Shimicoat contractors. Shimicoat is not responsible for repairs performed by third-party subcontractors.
  5. 3.5 Material availability: In the event that original materials are no longer available, Shimicoat may substitute with the closest available alternative. However, no guarantee is made that the repaired area will seamlessly match the surrounding untreated areas in terms of colour, texture, or appearance.
  6. 3.6 Accommodation: Shimicoat is not liable for providing accommodation, travel, or any other associated facilities in connection with warranty claims.
  7. 3.7 Liability cap: In cases where system failure is directly attributable to product failure or faulty workmanship by Shimicoat, the maximum liability for repairs shall not exceed the original paid contract value, prorated over the warranty period.
4.

Research and development

The Client acknowledges that Shimicoat's Research and Development (R&D) Department continually refines and improves its products and services. The Client is solely responsible for ensuring the suitability of Shimicoat products and services for their specific application and requirements. It is the Client's responsibility to verify the appropriateness of the products for their particular surface and usage.

5.

Limitation of liability

Shimicoat provides high-quality products and services, but acknowledges that installed floors are susceptible to incidental surface damage, including but not limited to chipping, scratching, UV discolouration, and chemical spills. Shimicoat may be contracted to repair such damage, in accordance with the terms of this warranty.

This warranty is non-transferable. Shimicoat shall not be liable for any loss, whether direct or indirect, arising from the use or application of its products.

Shimicoat is not obligated to process or assess any warranty claim unless all invoices have been paid in full. Any additional costs associated with warranty claims will be charged according to the contractor's pricing at the time the defect is identified.

6.

Warranty reporting procedure

  1. 6.1 Notification of defects: In the event of a product failure during the warranty period, the Client must notify Shimicoat immediately via email, providing full details of the defect or failure.
  2. 6.2 Isolation of damaged area: The Client must isolate the damaged area from use to prevent further damage, moisture ingress, or contamination until the repair is completed.
  3. 6.3 Access for inspection: The Client must provide Shimicoat contractors with unhindered access to inspect and assess the failure.
7.

Product data sheets and safety information

The Client is advised to carefully review Shimicoat's Product Data Sheets (PDS), Safety Data Sheets (SDS), and Technical Data Sheets (TDS), which are available on the Shimicoat website or upon request. These documents contain important information regarding the products' performance, application methods, and safety considerations.

The information provided in Shimicoat's Product Data Sheets is accurate to the best of our knowledge at the time of publication. Given the numerous variables that may affect product performance and application, Shimicoat is responsible only for the quality of the product at the time of dispatch. Application methods, performance data and safety information may change, so please check the current documents before use.

Field services disclaimer

Shimicoat does not assume supervisory responsibility for any field services it provides. Any advice, recommendations, or suggestions made by Shimicoat's Technical Team, whether given orally or in writing, are intended solely for informational purposes. The Client, engineer, or contractor is responsible for ensuring that appropriate procedures are followed for their specific application.

9.

Product disclaimer

Shimicoat's technical information and application advice are based on the current state of scientific and practical knowledge. As this information is of a general nature, Shimicoat provides no warranty regarding the suitability of its products for any specific application.

Shimicoat is not responsible for misuse or mishandling of its products, including any adverse reactions or performance when combined with other products or applied to particular surfaces. The Client is solely responsible for verifying the product's suitability for their intended use.

10.

Additional terms

Shimicoat's liability for products sold is governed by its standard terms and conditions of trade, which are available on the Shimicoat website. Shimicoat shall not be held liable for any loss arising from the use or application of its products, irrespective of adherence to any provided recommendations or advice.
